1. What this License covers

This Software License applies to CaptionPop desktop/Premiere integration components, scripts, panels, MOGRTs, templates, preset data, documentation and other proprietary materials supplied with CaptionPop (collectively, the “Licensed Materials”). It supplements the Terms of Service.

2. Ownership

DAHAMSTUDIO and its licensors retain all ownership and intellectual-property rights in the Licensed Materials. Your subscription purchases a right to use the Licensed Materials; it does not purchase ownership of the source files, code, templates or brand.

3. License grant

During a valid subscription, we grant the authorized subscriber a limited, non-exclusive, non-transferable and non-sublicensable license to install and use CaptionPop for the subscriber’s own personal, professional and commercial production work, subject to this License.

• You may create an unlimited number of ordinary video projects unless the applicable plan states a specific usage limit.
• You may monetize and commercially distribute completed video outputs created with CaptionPop.
• You may create work for paying clients.

4. Authorized user and device limit

Unless a plan states otherwise, one subscription is for one individual authorized user and may be registered on up to 2 devices controlled by that user.

• Device registration may be replaced or released through supported account/device-management procedures.
• A device slot does not authorize a second person to share the same subscription.
• Team or enterprise use requires a plan that expressly permits the required number of users.

5. Commercial and client work

You may deliver completed rendered videos to clients and the client may use those completed outputs for the agreed project. The client does not receive a reusable CaptionPop software or template license merely because a finished video is delivered.

• An editable project may be handed to a client only if it does not include CaptionPop assets in a form that can be extracted and reused independently, or the recipient has its own valid CaptionPop license covering that use.
• Lawfully completed and rendered outputs remain usable after your subscription ends.

6. MOGRTs, templates and protected assets

MOGRTs, templates, graphics, expressions, scripts and other CaptionPop production assets are tools, not stock assets for redistribution.

• You may modify settings exposed by CaptionPop and use the results in video projects.
• You may not sell, upload, share, package or redistribute a MOGRT, template, preset, source asset or a derivative whose primary purpose is to provide the reusable CaptionPop asset to others.
• You may not extract protected components for use as a competing template pack, extension, library or service.

7. User-created material and outputs

CaptionPop does not claim ownership of your original subtitle text, source media, editing decisions or other user-created material. You remain responsible for the rights to your inputs. Subject to third-party rights, your completed outputs belong to you or your client as agreed between you and them.

8. Third-party fonts, software and components

Some workflows may reference fonts, Adobe products, open-source software or other third-party materials. Those materials remain subject to their own licenses.

• A CaptionPop subscription does not automatically grant a commercial font license or Adobe software license.
• If a font or component is separately distributed under an open-source or third-party license, that license governs that component to the extent required.

9. Restrictions

Except as expressly permitted by mandatory law, you may not:

• share, transfer, sell, rent or sublicense your CaptionPop account or license;
• redistribute the installer, protected MOGRTs, templates, scripts, code or other Licensed Materials outside an authorized distribution method;
• remove or falsify copyright, trademark or license notices;
• circumvent activation, device restrictions, authentication or other technical protection measures;
• reverse engineer, decompile or disassemble CaptionPop, except to the limited extent a mandatory law expressly permits such activity despite this restriction;
• use CaptionPop or its assets to create a service whose primary purpose is to provide third parties with extractable CaptionPop assets.

10. Updates and version compatibility

An active subscription may include updates and maintenance releases that we make generally available for the subscribed product. We may change technical requirements when necessary for security, Adobe compatibility or product development.

• We do not promise perpetual compatibility with every past or future version of Adobe Premiere Pro, After Effects, operating systems or third-party fonts.
• Where practical, material compatibility requirements will be disclosed on the website or release notes.

11. License verification and offline use

CaptionPop may require periodic online license verification and device registration. After a successful verification, the software may allow a limited offline grace period of up to 72 hours, subject to product configuration and security requirements.

• The offline period does not extend the paid subscription term.
• Authentication records and device identifiers are handled as described in the Privacy Policy.

12. Payment failure, suspension and termination

If a subscription expires, a recurring payment fails beyond an applicable grace period, or the account is terminated for a material breach, new use of licensed features may be disabled.

• For remediable breaches, we will generally provide reasonable notice and an opportunity to cure unless immediate action is justified by fraud, security, abuse or law.
• Termination does not require you to delete ordinary rendered videos lawfully completed while the license was valid.
• After the license ends, you must stop using CaptionPop to create new work unless another valid license applies.

13. No transfer of source rights

No clause grants a right to use CaptionPop trademarks as your own brand, claim authorship of CaptionPop assets, or obtain source-code rights. Rights not expressly granted are reserved.

14. Warranty and mandatory rights

The Licensed Materials are provided with the warranties required by applicable law. Nothing here excludes remedies for defective or non-conforming digital content where those remedies cannot be waived.

15. Governing law and consumer rights

This License is governed by the laws of the Republic of Korea, while preserving mandatory consumer and software-interoperability rights that apply in the user’s jurisdiction.

16. License changes

We may update this License prospectively. Material changes affecting existing paid rights will be notified as required by law and will not retroactively invalidate completed outputs lawfully created under an earlier valid license.

1. 적용대상

본 소프트웨어 라이선스는 CaptionPop의 Premiere 연동 구성요소, 스크립트, 패널, MOGRT, 템플릿, 프리셋 데이터, 문서 및 그 밖의 독점적 자료(이하 “라이선스 자료”)에 적용되며 이용약관을 보충합니다.

2. 소유권

라이선스 자료의 소유권 및 지식재산권은 다함스튜디오 또는 정당한 권리자에게 귀속됩니다. 구독료는 라이선스 자료를 사용할 수 있는 권리에 대한 대가이며 소스파일, 코드, 템플릿 또는 상표의 소유권을 구매하는 것이 아닙니다.

3. 사용권의 부여

유효한 구독기간 동안 승인된 구독자 1명에게 본 라이선스에 따라 CaptionPop을 설치하고 개인·업무·상업적 영상제작에 사용할 수 있는 제한적·비독점적·양도 불가능·재라이선스 불가능한 사용권을 부여합니다.

• 해당 플랜에 별도 이용량 제한이 명시되지 않는 한 일반적인 영상 프로젝트의 수를 제한하지 않습니다.
• CaptionPop으로 완성한 영상 결과물을 수익화하거나 상업적으로 배포할 수 있습니다.
• 유료 클라이언트 작업에 사용할 수 있습니다.

4. 사용자 및 기기 제한

플랜에서 달리 정하지 않는 한 1개 구독은 1명의 승인된 사용자에게 제공되며 해당 사용자가 관리하는 최대 2대의 기기에 등록할 수 있습니다.

• 지원되는 계정·기기관리 절차를 통해 등록기기를 해제하거나 교체할 수 있습니다.
• 기기 2대 등록권한이 2명의 사용자가 하나의 구독을 공유할 수 있다는 의미는 아닙니다.
• 복수 사용자 또는 팀 사용은 해당 인원수를 명시적으로 허용하는 별도 플랜이 필요한 경우가 있습니다.

5. 상업적 이용 및 클라이언트 납품

완성된 렌더링 영상은 클라이언트에게 납품할 수 있고, 클라이언트는 해당 프로젝트의 완성 결과물을 사용할 수 있습니다. 단순히 영상 결과물을 납품했다고 해서 클라이언트에게 CaptionPop 소프트웨어나 재사용 가능한 템플릿 라이선스가 이전되는 것은 아닙니다.

• 편집 가능한 프로젝트 파일을 클라이언트에게 넘길 경우 CaptionPop 자산이 독립적으로 추출·재사용될 수 없는 형태여야 하며, 그렇지 않은 경우 수령자에게 해당 이용을 포괄하는 유효한 CaptionPop 라이선스가 있어야 합니다.
• 구독기간 중 적법하게 완성·렌더링한 결과물은 구독 종료 후에도 계속 이용할 수 있습니다.

6. MOGRT·템플릿 및 보호자산

MOGRT, 템플릿, 그래픽, 표현식, 스크립트 및 CaptionPop 제작자산은 영상을 만들기 위한 도구이며 원본자산 자체를 재판매·재배포하는 스톡 상품이 아닙니다.

• CaptionPop이 제공하는 편집범위 내에서 설정을 수정하여 결과물에 사용할 수 있습니다.
• MOGRT, 템플릿, 프리셋, 소스자산 또는 그 변형을 다른 사람이 재사용할 수 있는 형태로 판매·업로드·공유·패키징·재배포할 수 없습니다.
• 보호된 구성요소를 추출하여 경쟁 템플릿팩, 확장프로그램, 라이브러리 또는 서비스로 제공할 수 없습니다.

7. 이용자 자료 및 결과물

CaptionPop은 이용자가 직접 작성한 자막문구, 원본 영상·음원, 편집결정 등 이용자 고유 자료의 소유권을 취득하지 않습니다. 이용자는 입력자료에 필요한 권리를 확보해야 하며, 제3자의 권리를 침해하지 않는 범위에서 완성 결과물의 권리는 이용자와 클라이언트 사이의 계약에 따라 귀속됩니다.

8. 제3자 폰트·소프트웨어·구성요소

일부 작업에는 폰트, Adobe 제품, 오픈소스 소프트웨어 및 기타 제3자 자료가 사용될 수 있으며 해당 자료에는 각자의 라이선스가 적용됩니다.

• CaptionPop 구독만으로 별도의 상업용 폰트 라이선스나 Adobe 제품 라이선스가 자동 부여되는 것은 아닙니다.
• 오픈소스 또는 제3자 라이선스가 별도로 적용되는 구성요소는 필요한 범위에서 해당 라이선스가 우선합니다.

9. 금지사항

강행법규가 명시적으로 허용하는 범위를 제외하고 다음 행위를 금지합니다.

• 계정 또는 라이선스의 공유·양도·판매·대여·재라이선스;
• 승인된 배포경로 외에서 설치파일, 보호 MOGRT, 템플릿, 스크립트, 코드 등 라이선스 자료의 재배포;
• 저작권·상표·라이선스 표시의 제거 또는 위조;
• 활성화, 인증, 기기제한 또는 기술적 보호조치의 우회;
• 강행법규가 제한적으로 허용하는 경우를 제외한 역설계·디컴파일·분해;
• 제3자가 CaptionPop 자산을 독립적으로 추출할 수 있도록 제공하는 것을 주목적으로 하는 서비스 제작.

10. 업데이트 및 호환성

유효한 구독에는 CaptionPop이 해당 제품에 일반 제공하는 업데이트 및 유지보수 릴리스가 포함될 수 있습니다. 보안, Adobe 호환성 또는 제품개발상 필요한 경우 기술적 요구사항을 변경할 수 있습니다.

• 과거·미래의 모든 Adobe Premiere Pro/After Effects 버전, 운영체제, 제3자 폰트와 영구적으로 호환된다는 것을 보장하지 않습니다.
• 가능한 경우 중요한 호환성 요구사항을 홈페이지 또는 릴리스노트에 안내합니다.

11. 라이선스 인증 및 오프라인 이용

CaptionPop은 주기적인 온라인 라이선스 확인과 기기등록을 요구할 수 있습니다. 정상 인증 후 제품설정 및 보안요건에 따라 최대 72시간의 제한적 오프라인 이용 유예를 허용할 수 있습니다.

• 오프라인 유예기간이 결제된 구독기간을 연장하는 것은 아닙니다.
• 인증기록과 기기식별자의 처리는 개인정보처리방침을 따릅니다.

12. 결제실패, 이용정지 및 라이선스 종료

구독기간 만료, 유예기간 이후의 정기결제 실패 또는 중대한 라이선스 위반으로 계정이 종료된 경우 새로운 라이선스 기능의 이용을 제한할 수 있습니다.

• 시정 가능한 위반은 사기·보안·남용·법적 요구 등 즉시조치가 필요한 경우를 제외하고 합리적인 고지와 시정기회를 제공하는 것을 원칙으로 합니다.
• 라이선스 종료는 유효한 기간 중 적법하게 완성된 일반 렌더링 영상을 삭제하도록 요구하는 의미가 아닙니다.
• 라이선스가 종료된 뒤 새로운 작업을 위해 CaptionPop 기능을 계속 사용하려면 다시 유효한 라이선스가 필요합니다.

13. 소스권리의 비이전

본 라이선스는 CaptionPop 상표를 자신의 브랜드처럼 사용할 권리, CaptionPop 자산의 저작자라고 주장할 권리 또는 소스코드에 대한 권리를 부여하지 않습니다. 명시적으로 허용하지 않은 권리는 권리자에게 유보됩니다.

14. 보증 및 강행 소비자권리

라이선스 자료에는 관련 법령이 요구하는 품질 및 계약적합성에 관한 보증이 적용됩니다. 하자 또는 계약불일치가 있는 디지털콘텐츠에 대해 법률상 포기할 수 없는 보수·교환·대금감액·환급 등의 권리는 제한하지 않습니다.

15. 준거법

본 라이선스는 대한민국 법률을 기본 준거법으로 하되, 이용자에게 강제로 적용되는 현지 소비자보호 및 소프트웨어 상호운용 관련 법적 권리를 제한하지 않습니다.

16. 라이선스 변경

라이선스는 장래를 향해 변경될 수 있습니다. 기존 유료사용권에 중대한 영향을 주는 변경은 법령상 필요한 방식으로 알리며, 이전의 유효한 라이선스 아래 적법하게 완성한 결과물을 소급하여 무효로 만들지 않습니다.

1. 対象

本ライセンスはCaptionPopのPremiere連携コンポーネント、スクリプト、パネル、MOGRT、テンプレート、プリセット、ドキュメントその他の専有資料（「ライセンス資料」）に適用され、利用規約を補完します。

2. 所有権

ライセンス資料の所有権・知的財産権はDAHAMSTUDIOまたは正当な権利者に留保されます。購入するのは使用権であり、ソース、コード、テンプレート、ブランドの所有権ではありません。

3. ライセンス付与

有効な契約期間中、認証された1名の利用者に対し、個人・業務・商用の映像制作でCaptionPopを利用するための限定的、非独占的、譲渡不可・再許諾不可の権利を付与します。

• プランに利用量制限が明記されない限り、通常の映像プロジェクト数は限定しません。
• 完成映像を収益化・商用配布できます。
• 有償クライアント制作に利用できます。

4. 利用者とデバイス

別途プラン条件がない限り、1契約は1名の認証利用者用で、その利用者が管理する最大2台のデバイスに登録できます。2台登録は2名で共有できることを意味しません。

5. 商用・クライアント制作

レンダリング済み完成映像をクライアントへ納品でき、クライアントはその完成成果物を利用できます。ただし再利用可能なCaptionPopソフトウェア・テンプレートのライセンスは移転しません。

• 編集可能なプロジェクトを渡す場合、CaptionPop資産を独立して抽出・再利用できない形にするか、受領者自身が有効なライセンスを有する必要があります。
• 有効期間中に適法に完成したレンダリング成果物は契約終了後も利用できます。

6. MOGRT・テンプレート

MOGRT、テンプレート、グラフィック、式、スクリプト等は制作ツールであり、元資産を再販売・再配布するためのストックではありません。

• 公開された編集項目を調整して映像制作に使用できます。
• 元資産または再利用可能な派生物を販売、共有、配布することはできません。

7. 利用者資料・成果物

利用者が作成・保有する字幕、メディア、編集内容の所有権をCaptionPopが取得することはありません。入力資料に必要な権利は利用者が確保します。

8. 第三者素材

フォント、Adobe製品、オープンソース等には各第三者ライセンスが適用されます。CaptionPop契約だけで第三者フォントやAdobe製品のライセンスが付与されるものではありません。

9. 禁止事項

• アカウント・ライセンスの共有、譲渡、販売、賃貸、再許諾;
• インストーラ、MOGRT、テンプレート、スクリプト、コード等の無断再配布;
• 権利表示の削除・改ざん;
• 認証・デバイス制限・技術的保護の回避;
• 強行法規が限定的に認める場合を除くリバースエンジニアリング等;
• 第三者にCaptionPop資産を抽出可能な形で提供することを主目的とするサービス。

10. 更新と互換性

有効な契約には一般提供されるアップデートが含まれる場合があります。すべての過去・将来のPremiere Pro、After Effects、OS、第三者フォントとの永続的互換性は保証しません。

11. 認証・オフライン利用

オンラインライセンス確認とデバイス登録を要求する場合があります。正常認証後、製品設定とセキュリティ要件により最大72時間の限定オフライン利用を許可する場合があります。

12. 支払失敗・停止・終了

契約終了、猶予期間後の支払失敗、重大な違反等の場合、新規のライセンス機能を停止できます。適法に完成した通常のレンダリング映像を削除する必要はありません。

13. ソース権利の不移転

CaptionPopのブランド、著作者表示、ソースコード等の権利は移転しません。明示的に付与されない権利は留保されます。

14. 保証・強行法上の権利

強行法上排除できないデジタルコンテンツの契約適合性、修補、交換、代金減額、返金等の権利は本ライセンスで制限されません。

15. 準拠法

大韓民国法を基本準拠法とし、利用者の居住地で強制適用される消費者保護・相互運用上の権利を制限しません。

16. 変更

本ライセンスの重要な変更は必要な方法で事前通知し、過去の有効なライセンス下で適法に完成した成果物を遡及して無効にしません。
